Overview

Mediation is a voluntary process where an impartial person (mediator) assists individuals and/or organisations find mutually acceptable ways forward, instead of litigating.

Nature of Mediation

More predictable.

Mediators do not make any orders or impose outcomes. Instead, they help parties find solutions.

Mediation is closed to the public. In contrast, in litigation the parties’ names and their conflicts are often made public, which can be distressing.

Mediation outsmarts litigation in many ways. In litigation, a court or tribunal will make a decision that might adversely impact upon a party. Whereas in mediation, the parties are in charge of the outcome.

How it works

Optional steps:

  1. A party books a confidential, free consultation: we explain the process and answer questions.
  2. We offer the other party their own confidential, free consultation.

Mandatory steps:

  1. Each party books their own confidential intake session, where we gather information about the dispute and assess whether mediation is suitable. This step must be taken before the steps below.
  2. One party books the mediation, paying 50%.
  3. The other party pays the remaining 50% within 3 days to secure the booking.
